Permanent Establishment (PE) Risk

Your team member is employed by Treba Kenya Ltd — not your UK entity. There is no employment relationship between your company and the staff member. The service agreement is between your UK company and Treba Ltd (England & Wales). This structure significantly reduces the risk of creating a taxable presence in Kenya.

IP Assignment

Treba's employment contracts include IP assignment clauses under English law. All work product created by your hire — inventions, designs, code, documentation — is assigned to your company.

Data Protection

Personal data transfers between the UK and Kenya are governed by an IDTA under UK GDPR. A DPA is executed per client. Staff access client systems via VPN or VDI — no data is stored on local machines. Kenya's Data Protection Act 2019 provides additional local safeguards.

Employment Liability
